1. Sponsor.  
The GOING FREE FLIGHT BIRTHDAY GIVEAWAY SWEEPSTAKES (the “Sweepstakes”) is sponsored by Scott's Cheap Flights, Inc. dba Going (“Going”) located at 4845 Pearl East Circle, Suite 118 PMB 28648 Boulder, CO 80301-6112 (“Sponsor”). This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram, Twitter, LinkedIn, TikTok, or Facebook.

2. Eligibility.  
The Sweepstakes is only open to legal residents of the United States who are at least 18 years old at the time of entry, and who are not otherwise prohibited from participating in the Sweepstakes as provided in ‎these Terms and Conditions. Employees, officers, and directors of sponsors, Instagram, Twitter, TikTok, LinkedIn, Facebook, partners, and their respective affiliates, subsidiaries, suppliers, dealers, advertising and promotional agencies, and their immediate family members and persons living in their same household are not eligible to participate in the Sweepstakes.

Entrants may not be (a) residents or citizens of any country that is subject to an embargo imposed by the U.S. ‎government‎ or (b) included in any sanctions program administered or enforced by the ‎U.S. government or ‎any agency thereof, including, but not limited to, ‎the U.S. Department of State, U.S. ‎Department of Commerce, U.S. ‎Department of Homeland Security, or U.S. Department of ‎Treasury and ‎specifically including the Specially Designated Nationals, Blocked ‎‎Persons, and Denied Persons Lists. Void wherever prohibited or restricted by law, rule, or regulation.  

By participating, you agree to these Terms and Conditions which will be final and binding in all respects. All federal, state, and local laws and regulations apply.  

3. Entry Period. 

The Sweepstakes begins at 07:59:59 AM Eastern Time on Monday, August 18, 2025, and ends at 7:59:59 PM Eastern Time on Friday, August 22, 2025 (the “Sweepstakes Period”).

4. How to Enter. 

You have two ways to enter the Sweepstakes, as set forth below: (1) Enter Sweepstakes through Instagram, or (2) enter by Google form.

Primary Entry Method: Submission through Instagram

You may earn one (1) entry each day of the Sweepstakes Period by completing the following steps:

1. Follow Going on Instagram and like a Sweepstakes post during the Sweepstakes period
2. Login into your Going app account, or download and sign up for a free account (no purchase necessary)
3. Look through the deals on the Going app and comment on the Instagram post with a deal you’d love to book. The deal shared in the comments must be a live deal currently published on our website at the time of the post.

Alternate Entry Method: Submission by Google form

For entrants who do not participate on Instagram, you may earn one (1) entry each day of the Sweepstakes period by filling out the online entry form:  

1. Login into your Going app account, or download and sign up for a free account (no purchase necessary)
2. Look through the deals on the Going app and select one you would like to book
3. Fill out the form at https://forms.gle/ezviQcpVqqjSK1zh6 including your first and last name, email address, home airport, destination of deal, price of the deal, and a screenshot of the deal (including the price) you’d love to book. The deal you submit must be a live deal currently published on our website at the time of the entry.

You may enter by only one of these methods one (1) time each day during the Sweepstakes Period (one entry per person, per day). Entrants must be Going members to participate (no purchase necessary; Limited membership is free at going.com or in the Going app). After successful completion and assuming you meet the eligibility requirements, you will automatically be entered in the Sweepstakes to win the prizes offered in the Sweepstakes.

Entries that do not comply with these Terms and Conditions, or that otherwise contain incomplete, prohibited, inappropriate, offensive, infringing, or otherwise unlawful or unacceptable content as determined by Going, in its sole discretion, will be disqualified, and will not receive an entry into the Sweepstakes (without notice to you). If you enter the Sweepstakes and are discovered to not be eligible to enter the Sweepstakes, you will be disqualified. If you are discovered to enter the Sweepstakes more than one (1) time each day, you will be disqualified.

5. Prizes; Odds of Winning.

One (1) winner will be selected randomly from all eligible entries received each weekday during the Sweepstakes Period, for a total of 23 winners, provided any such winners must comply with these Terms and Conditions as a condition to receiving the prizes. Each entrant is eligible to win one time throughout the Sweepstakes Period.

The prizes offered include:

• One free flight awarded daily August 18 - August 22 2025. 

The commercial value of the prizes will range each day, with the actual value of each prize dependent on the deal selected by each winner. The value of the prizes is indicative and determined at the time of the implementation of these rules and their evaluation may not be contested.

Prizes will be issued via flightgift.com in the dollar amount of the winner’s selected flight deal. Flightgift gift cards have 24-month validity. Going is not responsible for Flightgift gift cards not redeemed before their expiration date. Flightgift gift cards are redeemable with 400+ international airlines.

The prizes do not include all the expenses not expressly foreseen in the above description, and in particular, without this list being exhaustive: accommodation fees, catering costs, travel expenses, and travel insurance. All costs incurred after the contest including the maintenance and use of the prizes are the entire responsibility of the winner.

In the event of a force majeure event or if the circumstances justify so, the Organizer reserves the right to substitute at any time for the proposed prizes other prizes of equal or greater value. The winners will be kept informed of any changes.

Prizes may not give rise to any dispute or claim whatsoever. The winners undertake not to hold the Organizer, its partners or, more generally, any supplier of the Organizer in the context of this contest, legally responsible in terms of endowments, including their delivery, condition and their quality.

The maximum retail value of all daily prizes combined is set at $2,550 USD. The value of the prizes is indicative and determined at the time of the implementation of these rules and their evaluation may not be contested.

No other prizes will be given to entrants as a result of participation in the Sweepstakes.  All taxes and, all costs and expenses, arising from the receipt or use of a prize are your sole responsibility. You may not transfer or assign your right to receive a prize. No prize substitutions are permitted, except by Going which reserves the right to change or replace a prize with a prize of comparable or greater retail value at any time. Odds of winning depend upon the number of eligible entries received at the time of the drawing. Additional restrictions, limitations, and exclusions may apply.

6. Notification of Winner.

A new winner will be selected and notified each day of the Sweepstakes Period (the “Notification Dates”). The potential prize winner will be selected in a random drawing from all eligible entries received the previous day, and the potential winner will be sent a notification from Going via direct Instagram message or via email or announced and tagged on the IG story (depending on method of entry) with instructions on how to claim the applicable prize (the “Notification”). The potential winner will be required to follow instructions on the Notification, and provide Sponsor with his/her first and last name, date of birth, and email address, and such other information as required by Sponsor, and the potential winner may be required to execute an Affidavit of Eligibility Release, Liability Release and Publicity Release (except where prohibited), as well as any required tax forms, to be returned within seven (7) days of the date on the Notification, or the prize will be forfeited and, at Sponsor's discretion, another potential winner will be selected at random from the eligible entries received during that Sweepstakes Period. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, fails to return the completed and executed Affidavits and Releases or required tax forms within the specified timeframe as required, or if the Notification or prize is returned as undeliverable, the applicable prize will be forfeited and another potential winner may be selected from the eligible entries received during that Sweepstakes Period. Sponsor reserves the right not to award a prize if Sponsor is unable to declare a potential winner within a reasonable timeframe, which shall be subject to Sponsor's sole discretion. By accepting or using a prize, the winner agrees that Sponsor can use the winner’s name, state of residence, voice, and likeness for advertising and promotional purposes without further compensation, unless otherwise prohibited by law as set forth below. All decisions of Sponsor shall be binding and final. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner. 

7. Right to Use Name, and Other Identifying Information. 

By entering the Sweepstakes, each entrant hereby irrevocably consents to the collection, processing, storage, unlimited reproduction, distribution, display, performance, and other use by Sponsor and its successors and assigns of his/her name and other personally identifiable information such as your email address, for any purposes directly or indirectly related to this Sweepstakes and as set forth in Sponsor's privacy policy located at https://www.going.com/privacy-policy, and in any format or medium now existing or later developed. The rights granted under this Section 7 are without compensation or notification to the entrant of any kind, except as required by law, and shall extend to all entries, all other materials submitted by the entrant, and all other materials developed in connection with the Sweepstakes, regardless of whether they are developed by the entrant or another person or entity.

8. Privacy/Use of Personal Information

Sponsor may collect and use personally identifiable information of and about entrants, online or otherwise. ‍Information submitted or collected in connection with the Sweepstakes will be treated in accordance with these Terms and Conditions and Sponsor’s Privacy Policy (https://www.going.com/privacy-policy). By entering the Sweepstakes, you acknowledge that you have read and accepted these Terms and Conditions and Sponsor’s Privacy Policy. 

9. Internet/General Provisions.

Sponsor is not responsible for entries (including, without limitation, data transmissions) that are late, lost, tampered with, illegible, unintelligible, incomplete, garbled, delayed, mutilated, forged, destroyed, stolen, misdirected, undeliverable, or mailed postage due or otherwise not in compliance with these Terms and Conditions, and such entries will be disqualified. Sponsor is not responsible for lost, interrupted, or unavailable network server or other connections, miscommunications, failed telephone, or computer or telephone transmissions or technical failure, jumbled, scrambled, or misdirected transmissions, data input errors, typographical errors on its website or in these Terms and Conditions, or any other error of any kind whether human, mechanical, or electronic, including, without limitation, the incorrect or inaccurate capture of entry information regardless of the cause. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified and entry material/data that has been tampered with or altered is void. Any use of robotic, automatic, programmed, or like entry methods or the use of multiple accounts to make entries will void all entries affected by such methods and be deemed tampering. If disqualified for any of the above abuses, Sponsor reserves the right to terminate such person’s eligibility to participate in the Sweepstakes. Sponsor may modify, suspend, or terminate the Sweepstakes at any time, and for any reason that it may determine in its sole discretion. Sponsor is not responsible for any problem with a Sweepstakes entry generated by computer hardware or software malfunction, error, or failure. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. If a potential winning entry is made online, that potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potential winning entry or account.  Sponsor reserves the right to amend these Terms and Conditions at any time during the Sweepstakes.  

10. Disputes/Choice of Law. 

Except where prohibited, you agree that this Sweepstakes shall be governed by the laws of the State of Colorado and: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in the City and County of Denver, Colorado.

11. Release and Limitation of Liability.

By entering the Sweepstakes, you agree to release, discharge, and hold harmless Going and its respective affiliates, subsidiaries, suppliers, dealers, advertising and promotional agencies, and their respective officers, directors, employees, and agents, from any claims, damages, losses, liabilities, injury or loss to person or property, costs and expenses of any form that you might incur as a result of participation in the Sweepstakes or from acceptance, receipt, use, misuse, or possession of the prizes, including but not limited to claims or causes of action arising out of or related to the following:

1. Any technical errors associated with the Sweepstakes, including lost, interrupted, or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability, or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower, or cable transmissions, lines, or technical failure;
2. Unauthorized human intervention in the Sweepstakes;
3. Mechanical, network, electronic, computer, human, printing, or typographical errors;
4. Lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due, or misdirected mail, entries, application downloads, or text messages;
5. Any other errors or problems in the administration with the Sweepstakes, including, without limitation, errors that may occur in the administration of the Sweepstakes, the announcement of the winners, the cancellation or postponement of the event, if applicable, the incorrect downloading of the application, the processing of entries, or any Sweepstakes-related materials;
6. Injury, death, losses, or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or acceptance, receipt, or misuse of the prize (including any travel or activity related thereto); and 
7. Any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. 

Except as otherwise provided, (a) any and all claims, judgments, and awards arising out of or related to the Sweepstakes shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees (except as otherwise provided in these Terms and Conditions); (b) no punitive, incidental, special, consequential, or other damages, including without limitation lost profits (collectively, “Special Damages”); may be awarded; and (c) you hereby waive all rights to claim Special Damages and all rights to have such damages multiplied or increased.  Under no circumstances shall Sponsor’s aggregate liability to you or any entrant of the Sweepstakes exceed One Dollar ($1.00).  

12. Winner List/Copy of Terms and Conditions.
